1. DotAsia may issue interpretive guidelines on its website or to prospective Participants regarding the provisions of these Terms and Conditions.  DotAsia may modify these Terms and Conditions from time to time, which modifications will take effect at the time they are announced on the Contest website and/or DotAsia Websites.
2. If any part of these Terms and Conditions is declared invalid or unenforceable for any reason, the remainder will be valid and enforceable as if the invalid or unenforceable part were not included herein. There shall be substituted for any invalid or unenforceable provision a suitable provision that, as far as is legally possible, comes nearest to the sense and purpose of these Terms and Conditions, taking into account all other applicable rules and policies.
3. DotAsia may in no case be held liable for any loss or damage caused by or in connection with: (a) the prizes, including, if applicable those provided by a third party, and presented by DotAsia or (b) any events outside DotAsia's direct or indirect control. If for any reason there is any error, including a computer or human error, in relation to the award or distribution of the prizes, DotAsia shall not be liable and Participant shall have no actionable claim against or right to compensation from DotAsia.
4. Regardless of the cause or reason therefore, including, without limitation, unintentional human error by any person, no responsibility is assumed by DotAsia for lost, late, incomplete, misdirected, or illegible submissions; or for any computer, telephone, cable, satellite, network, electronic or Internet hardware or software malfunctions, failures, lost or unavailable connections, failed, delayed, garbled or jumbled transmissions, service provider/Internet/web site/use net accessibility or availability, traffic congestion, or unauthorized human intervention.
5. If for any reason the Contest is not capable of running as originally planned due to any reason, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures which in DotAsia's sole discretion corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, DotAsia reserves the right, at its sole discretion, to terminate, modify or suspend the Contest. In the event the Contest is so terminated, then these Terms and Conditions will be considered null and void and of no further force or effect  (except Sections 2.8, 7.3 to 7.8, which shall survive indefinitely), and DotAsia will have no obligations or liability of any kind to any Participant. In the event the Contest is so suspended or modified, then DotAsia may determine, in its sole discretion, when and/or with what modification(s) the Contest will resume, and any subsequent Winner(s) will be determined in a manner which DotAsia determines, in its sole discretion, is fair, appropriate and consistent with these Terms and Conditions.
6. DotAsia and its respective agencies are not responsible for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest, and DotAsia and its respective agencies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Contest website, regardless of the cause or reason therefore. DotAsia and its respective agencies are not responsible for injury or damage to participants or to any other person's computer related to or resulting from participating in this Contest, from uploading or downloading materials to or from any website, or from use of any website.
7. IN NO EVENT WILL DOTASIA AND ITS RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR RESPECTIVE ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS. DIRECTORS, EMPLOYEES, MEMBERS, SHAREHOLDERS, ATTORNEYS, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES ARISING OUT OF ANY PARTICIPANTS' ACCESS TO AND USE OF ANY INTERNET SITES OR FROM UPLOADING OR DOWNLOADING TO/FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, DOTASIA AND ITS RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR RESPECTIVE ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS. DIRECTORS, EMPLOYEES, MEMBERS, SHAREHOLDERS, ATTORNEYS, REPRESENTATIVES AND AGENTS MAKES NO WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE OR NON-INFRINGEMENT WITH RESPECT TO ANY WEBSITE UTILIZED TO ENTER THIS CONTEST. FOR THE AVOIDANCE OF DOUBT, NO PROVISION IN THESE TERMS AND CONDITIONS SHALL BE CONSTRUED AS LIMITING THE LIABILITY OF ANY PARTY FOR DEATH OR PERSONAL INJURY CAUSED BY SUCH PARTY'S NEGLIGENCE OR ANY LIABILITY WHICH CANNOT BE EXCLUDED UNDER GENERALLY APPLICABLE LAW.
8. By participating in this Contest, each Participant, releases, indemnifies and holds harmless DotAsia and its respective parents, affiliates, subsidiaries, successors, assigns and licensees, the service agencies and independent contractors of any of the above organizations and their respective directors, officers, employees, members, shareholders, attorneys, representatives and agents, including advertising and promotion agencies, from and against any and all liability, judgments, claims, losses, damages, costs and expenses (including, without limitation, reasonable outside attorneys' fees) with respect to or in any way arising from participation in the Contest or the awarding, acceptance, possession or use (or misuse) of the Contest award, including, but not limited to, liability for personal injury.
9. These Terms and Conditions, and the relationship between the Participant and DotAsia are governed by and construed in accordance with the laws of Hong Kong SAR.  Any dispute, controversy or claim arising out of or relating to the Contest, or the breach, termination or invalidity thereof, shall be resolved amicably by all parties first, failing which by arbitration at the Hong Kong International Arbitration Centre under the UNCITRAL Arbitration Rules in accordance with the HKIAC Procedures for the Administration of International Arbitration.  The arbitration shall be conducted in the English language by one arbitrator appointed by DotAsia.  The arbitration award shall be final and binding on the parties.  The party who wishes to initiate arbitration proceedings shall notify the other parties in writing fifteen (15) days before such commencement.
